An assistant of the defense team of ICT was arrested while making photocpies of documents provided by the tribunal itself

Stockport son’s fears as ‘political icon' faces death penalty over alleged war crimes in Bangladesh

Numan Azmi says his father Prof Ghulam Azam, right, will not get a fair trial in Bangladesh
Numan Azmi says his father Prof Ghulam Azam, right, will not get a fair trial in Bangladesh

The family of a former political leader accused of masterminding war crimes during Bangladesh’s liberation struggle have criticised his arrest.
Ghulam Azam, 89, led the anti-independence Jamaat-e-Islami party during the Bangladesh Liberation War of 1971. He was arrested last week by the International Crimes Tribunal in his homeland.
Mr Azam denies 62 charges - which include murder, rape, arson and looting. But supporters say his arrest is politically motivated.
His son Numan Azmi, 49, who has lived in Stockport for more than 30 years, fears his father – who could face the death penalty – will not receive a fair trial.
He said: "We are not saying we are against these trials, but we want them to be just and to be fair and at the moment we do not believe this will be the case.
"These are show trials which are targeting just one group of people aligned to one political party for the political motives of the current pro-independence government.
"Spiritually my father is strong but physically he is very weak. He is quite frail and cannot walk unaided and it concerns me greatly what he is being put through when there is not a shred of evidence against him."
Mr Azam, who briefly lived in Manchester during a six-year exile from his homeland, has become a political icon among pro-Islamist groups.
He delivered a famous speech in the city in 1973 against the creation of Bangladesh.
In 2010, the Bangladeshi government set up the International Crimes Tribunal in Dhaka to bring trials against those accused of committing atrocities during the struggle.
Human rights organisation Human Rights Watch has raised concerns over the trials, which they believe fall short of international standards after defence lawyers reported being harassed by police and state officials.
A Foreign Office spokesman said: "We support holding war-crime trials where evidence suggests that war crimes may have been committed, but it is essential that any trial meets internationally agreed standards of justice. Trials should be open, transparent, include the right to conduct a proper defence and be in accordance with appropriate human-rights standards."

Ex-chief of Bangladesh’s largest Islamic party jailed pending trial on war crimes charges

DHAKA, Bangladesh — A tribunal ordered the former chief of Bangladesh’s largest Islamic party jailed Wednesday pending trial on charges he instigated deadly rampages against civilians during the 1971 war of independence from Pakistan.
Ghulam Azam, 89, a regional chief of Jamaat-e-Islami during the war and later the party’s leader in Bangladesh, is accused of having command-level authority in attacks — including slayings, arson, rape and looting — by then-Pakistani soldiers and their collaborators on people in what was then eastern Pakistan.

The International Crimes Tribunal in the capital, Dhaka, denied Azam’s request for bail Wednesday and ordered him jailed while awaiting a trial, which is expected by next year.
Azam denies the charges, and his supporters say the case against him is politically motivated. Trying the 1971 war crimes is a challenge for the government of Prime Minister Sheikh Hasina in part because many of the key defendants are her bitter political enemies.
International groups, including the New York-based Human Rights Watch, have urged the Bangladesh to ensure war crimes defendants receive fair trials by clarifying the definition of charges and allowing the accused to question the tribunal’s impartiality — currently not allowed under Bangldeshi law.
Despite Azam’s retirement from Jamaat-e-Islami in 2000, he is still thought to be the de facto leader of the party, a fierce rival of the ruling Awami League party led by Hasina, who is the daughter of independence leader Sheikh Mujibur Rahman.
Jamaat-e-Islami is a key partner of a political alliance led by former prime minister and opposition leader Khaleda Zia. Two leaders of Zia’s Bangladesh Nationalist Party face similar charges.
Azam went into exile after Pakistani soldiers surrendered to a joint force led by India on Dec. 16, 1971 and returned in 1978. He became party chief in 1991.
Azam arrived at Wednesday’s hearing in a wheelchair and his lawyer, Abdur Razzaq, said he had sought bail citing health complications. He said the denial of bail was wrong, and noted that Bangladeshi law related to the war crimes trial does not allow the defense to challenge the ruling in a higher court during the trial process.
But any person convicted for war crimes will be able to appeal the final verdict of the tribunal in the Supreme Court.
The three-judge panel, created by Hasina’s government in March 2010, also set Feb. 15 for a hearing on charges for a possible indictment.

Bangladesh 'war crimes mastermind' Ghulam Azam arrested

Bangladesh has arrested an Islamist leader on charges of masterminding war crimes during the 1971 liberation struggle against Pakistan, lawyers say.
Bangladeshi police officers escort Ghulam Azam to jail in Dhaka
Mr Azam is one of the most high profile Jamaat-e-Islami leaders
Prosecutors say that Ghulam Azam, 89, was detained after the International Crimes Tribunal (ICT) rejected his bail application.
They accuse Mr Azam of crimes against humanity - including murder, rape, arson and looting - in 1971.
He denies the charges, arguing that they are politically motivated.
Mr Azam, the former leader of the opposition Jamaat-e-Islami party, is alleged to have created and led pro-Pakistan militias which carried out numerous murders and rapes during the nine-month war.
"He was the mastermind of all crimes against humanity during 1971," state prosecutor Syed Haider Ali told the AFP news agency.
The ICT rejected the bail request made on health grounds by Mr Azam, a wheelchair user, and ordered him to remain in jail while awaiting trial, which is expected next year.
In November, another Jamaat-e-Islami leader, Delawar Hossain Sayedee, went on trial accused of crimes against humanity during the country's independence struggle.
Mr Sayedee was the first of seven suspects set to face a tribunal on charges relating to the 1971 war.
Charges listed against him include genocide, rape and religious persecution - all of which he denies.
Prosecutors say such trials are vital for the establishment of democracy in Bangladesh, which has yet to come fully to terms with its violent past.
The special court is trying Bangladeshis accused of collaborating with Pakistani forces, who were trying to stop Bangladesh becoming an independent nation.

It was set was set up in Dhaka in 2010 without any involvement by the United Nations.
It is not clear exactly how many people were killed. Independent researchers think that between 300,000 and 500,000 died, but the Bangladeshi government puts the figure at three million.
Correspondents say that Mr Azam is one of the most high profile Islamists to have been arrested since the nation's secular government set up the tribunal in 2010 to try suspects.
Two senior members from the main opposition Bangladesh Nationalist Party (BNP) are also facing war crime charges.

Both the BNP and Jamaat-e-Islami have dismissed the court as a government "show trial", a view supported by Human Rights Watch who recently said that its legal procedures fell short of international standards.

Mr Azam's lawyer, Abdur Razzak, strongly criticised his arrest, which came after he was called to appear before the tribunal.

"We don't know yet the charges against him, the order was not correct. He is also very old. Still, our bail petition was rejected," he said.

Bangladesh was called East Pakistan until 1971 when the nine-month war of secession broke out.
The trials of war crimes suspects are likely to go on for many months.

[CNN] Bangladesh convicts teacher for Facebook post about prime minister

Dhaka, Bangladesh (CNN) -- A Bangladeshi university teacher was convicted Wednesday of wishing death to the prime minister on his Facebook wall.
The Bangladesh High Court handed down a six-month sentence to M Ruhul Amin on a contempt charge, saying he failed to comply with a court order after his remarks on Facebook, said deputy attorney general ABM Altaf Hossain.
Amin, who teaches Information Technology at Jahangirnagar University and is in Australia on a study leave, was not available for comment.
Hossain said Amin was tried in absentia.
After the August road accident death of Tareq Masud, a leading filmmaker in Bangladesh, Amin used his Facebook status to blame the government's negligence for many deaths in road accidents. He also wished death to Prime Minister Sheikh Hasina, the court said.
Justice AHM Shamsuddin Chowdhury and Justice Jahangir Hossain asked the government to take measures to bring Amin back from Australia so he can be jailed.
The court also asked the university to take action against Amin.
Bangladesh state transport authorities estimate up to 4,000 people every year die in road accidents. Independent researchers say they believe the actual number of deaths is much higher.

[BBC] Bangladesh man given jail term for PM Hasina Facebook post

Bangladesh prime minister Sheikh Hasina - file photo April 2007
Ruhul Khandakar was found guilty in absentia of contempt of court after failing to return from Australia in response to a court summons.
Last year Mr Khandakar posted comments implying that he wanted Sheikh Hasina to die, high court officials said.
His comment reportedly related to Bangladesh's high road fatality rate.
It was posted following the death of one of the country's best known film makers, Tareq Masud, in a road accident in August, which left many Bangladeshis deeply shocked.
According to officials, Ruhul Khandakar blamed the government for the fact there are so many road deaths in Bangladesh.
"Tareq Masud died as a result of government giving licence to unqualified drivers. Many die, why does not Sheikh Hasina die?" his Facebook post said, according to court officials quoted by the AFP news agency.
When the comments appeared in the media, there were protests by the prime minister's supporters.
The high court ordered officials to return Mr Khandakar, who is studying in Australia, to Bangladesh. It also directed his university employers to take action against him.

BNP wants the War Crimes Tribunal to be stopped at once as it is biased

The main opposition BNP yesterday demanded that the government immediately stop the proceedings of the war crimes tribunal.

The party also called on the international community to raise objections to what it said was the tribunal's violation of human rights in an extra-judicial manner.

The world, it said, must put pressure on the government to fulfil the commitments Bangladesh had made through signing international covenants on crimes against humanity.

Flanked by senior party leaders, former law minister Moudud Ahmed read out the demands at a press conference at the party's Naya Paltan headquarters in the capital.

"The BNP has no confidence in this tribunal. It believes that in the existing legal structure, the tribunal is nothing but a servile, rubber-stamp organisation," he said in a written statement.

Moudud observed that it made no sense to legitimise the tribunal's “illegal and unconstitutional trial proceedings by participating in its farcical activities to victimise political opponents”.

Referring to the recommendations of Stephen Rapp, US ambassador-at-large for war crimes issues, the opposition lawmaker said, "We agree with the recommendations. The tribunal cannot be independent and transparent without implementation of those suggestions."

He then cited some of the recommendations Ambassador Rapp made during his Dhaka tour: the tribunal should define the crimes against humanity; an individual accused of war crimes should get the same time and support as the accused in other cases get to defend themselves; the trial proceedings should be broadcast on television and radio; and foreign lawyers should be allowed in as consultants.

The opposition party also demanded immediate release of its lawmaker Salauddin Quader Chowdhury, who has been detained on charges of crimes against humanity.

Moudud said, "Salauddin believes it will amount to an extra-judicial killing if he is condemned to death by a biased and one-sided tribunal, depriving him of the fundamental rights he has like any other citizen."

The BNP leader claimed Salauddin had sent 23 applications to the tribunal from jail. While some of those applications had been lying at the Gazipur deputy commissioner's office, the rest had disappeared without trace.

Besides, he said, the tribunal had taken the charges against Salauddin into cognisance in his absence and without giving him any notice. It only had discussions with the prosecution.

Moudud maintained that his party too wanted the “real war criminals” to be tried under the existing laws of the land. However, that trial would have to be conducted though a transparent and impartial legal process, and there must not be any doubt in the public mind about the modalities of the trial.

BNP acting secretary general Mirza Fakhrul Islam Alamgir and members of the party's national standing committee were among those present at the press conference.

Human Rights Commission chief Mizan says Stephen J. Rapp is working like a Mercenary for Jamaat

In this Interview with Barta24.net Human Rights Commission chief Mizan says Stephen J. Rapp and/or the US government is working like a Mercenary for Jamaat e Islami

A War Crimes Court and a Travesty of Justice

by – NYTimes.com

DHAKA, Bangladesh — On the fourth floor of a nondescript pale-blue government building in Old Dhaka, clerks are stapling together copies of depositions from witnesses to the crimes committed during Bangladesh’s 1971 war of secession from Pakistan — a conflict that may have killed up to three million people, according to the Bangladeshi government. Above them on the wall is a map showing the 11 sectors of what was then called East Pakistan.

In the office next door sits Abdul Hannan Khan, the chief investigator for the International Crimes Tribunal in Bangladesh, a court set up by the Bangladeshi government in March 2010 to “try and punish any individual or group of individuals, or any member of any armed, defence or auxiliary forces, irrespective of his nationality” who committed crimes against humanity, genocide, and war crimes, among other things, in 1971. Khan, a former police inspector general, is an affable man, in control and in no rush, who seems remarkably uninterested in politics. He says that his agency has finished investigating seven people. On Nov. 20th, the first of them, Delwar Hossain Sayedee, a leader of Jamaat-e-Islami, an Islamist party opposed to Bangladesh’s independence, was charged with a slew of crimes. He will soon be joined in the dock by nearly the entire Jamaat leadership, including its former chief, the 89-year old Ghulam Azam, and two prominent members of the opposition Bangladesh Nationalist Party (BNP).

No trial has yet taken place, but it already seems clear that the International Crimes Tribunal is an international tribunal in name only. Its exclusive focus on the Bangladeshis who bloodied their hands assisting the main perpetrators — the Pakistani military — makes the court look like an government appendage eager to settle a domestic score. Trying and punishing members of the former Pakistani Army is too sensitive politically for the current Bangladeshi government to even contemplate: it could cause a complete breakdown in relations with Pakistan. It would also be impractical, because there is no extradition treaty between Bangladesh and Pakistan.

More arrests are sure to follow. Khan is investigating 10 other suspected collaborators, including another six members of the Jamaat and two of the BNP. There is also Ashrafuzzaman Khan, an American, and Moinuddin Chowdhury, a British citizen, both alleged leaders of the pro-army paramilitary body called Al Badr, which massacred Bengali intellectuals in December 1971. Khan says that Khan lives in New York and Chowdhury in “UK, London.” Their being far away might seem like a serious obstacle, but according to one political analyst (who wishes not to be identified), even those cases will be a “slam dunk” because the two men will probably be tried — and convicted — in absentia.

The tribunal is shaping up to be a travesty of justice. The government seems to be using the court simply to rubberstamp a predetermination that the accused are guilty. For most Bangladeshis, that truth has been established since 1995, when a self-appointed panel of eminent citizens, headed by the current justice minister, compiled “evidence” of war crimes against 16 individuals, including the seven men currently awaiting trial before the International Crimes Tribunal. The Jamaat members’ defense team has asked one of the judges to step down because he sat on the 1995 panel. If, as is nonetheless expected, nearly the entire leadership of the Jamaat is convicted and hanged within two years, the Bangladeshi opposition will be conveniently weakened in time for the next parliamentary election in 2013.

Such a nakedly partisan exercise of justice would make it much harder for an accurate history of Bangladesh’s birth to ever be written. According to M. A. Hasan, of the War Crimes Fact Finding Committee, an independent body investigating the 1971 massacres, 95 percent of the atrocities were committed by Pakistani soldiers who resisted secession — and were under orders to kill to prevent it — on the theory that the Islamic unity of the two wings of Pakistan must not be compromised.

Yet none of them will be in court. Nor will any member of the pro-independence militias be charged for massacring tens of thousands of Bihari migrants who sympathized with Pakistan. The current list of accused looks so conveniently expedient for the Awami League of Prime Minister Sheikh Hasina that for the sake of appearance alone Hasina might have better served herself, and Bangladesh, by making a greater show of endorsing an independent war crimes trial subject to international standards. The defense teams do count some high-caliber international lawyers, but the government has effectively barred them from being present in court by making it hard for them to even get into the country.

In the midst of all the politicking, Hasan has somehow managed to adopt an impartial position. A few years back, he submitted to the government a list of 1,775 suspected war criminals, including the accused currently on trial but also collaborators from the Awami League’s coalition partners and members of the former Pakistani military. At the end of a visit to his office last Tuesday, during which he bemoaned continued impunity, Hasan produced what he called a “genocide map” of Dhaka. It showed 48 mass graves, with latitudes and longitudes.

Washington expresses 'grave concern' over war crime trial

GEOPOLITICS UNDER TRANSFORMATION

by M. Shahidul Islam, Friday January 21;Weekly Holiday

Within years of being catapulted as a pre-eminent regional power, India is on the verge of losing its wind-fallen clout due to some new variables having intervened to re-structure the South Asian geopolitical landscape.
Consequently, the AL-led coalition govt. is under intense pressure to change courses in domestic and international policy pursuance.
The prime mover of this geopolitical shift is the US President Barack Obama, who seems to have re-set his focus on working with China more closely, seemingly at the cost of India, in a desperate bid to retrieve the US's and the global economy from a grinding stagnation that has begun to spark Tunisia-type upheavals in many countries.
The increased Washington-Beijing intimacy has also been necessitated by factors such as dealing with North Korea and Iran, the two nations inexorably moving toward military-nuclearization and, over which Beijing wields enormous influence.
Besides, Beijing's recent decision to trade with Russia using their respective currencies-which further reduced demand on US dollar - has become a major concern in Washington.

The British government faces a legal challenge over allegations it was complicit in the torture of Bangladeshi MP Salauddin Chowdhury, who was arrested by the country's security forces earlier this month.

Lawyers acting for the 63-year-old's family claim the training provided by British forces to Bangladesh's Rapid Action Battalion [RAB], which arrested Chowdury, places the UK in breach of its obligations under international law.

RAB members have been held responsible for hundreds of extrajudicial killings since the unit was established in 2004. The unit itself admits to being responsible for more than 600 deaths, which it euphemistically attributes to "crossfire".

Details of British support for RAB were revealed in US embassy cables released by WikiLeaks and reported by the Guardian. They show that Britain has been providing training in "investigative interviewing techniques" and "rules of engagement".

According to Amnesty International, Chowdury was detained and tortured by RAB officers and Bangladeshi intelligence officials at an apartment in the Banani district of Dhaka on 16 December. His captors are alleged to have brought with them a number of torture implements and a doctor, who is alleged to have revived him three times after he lost consciousnes. The mistreatment is said to have included applying electrodes to his genitals, beating him, slitting his stomach with razors and twisting his toenails and fingernails with pliers.

According to Amnesty, Chowdury was initially arrested for questioning over an arson attack in which a person died, and was then reported to have been charged with offences allegedly committed during Bangladesh's 1971 war of independence. He is now being held in prison in Bangladesh.

Today his son, Fayyaz Chowdury, called on the British government to intervene.

"The UK government is up to its neck in this case having provided practical and financial support to RAB who are responsible for my father's ill-treatment. I am a British national and they must now intervene to secure my father's immediate release from prison and a binding undertaking from the Bangladesh government that he will not be subjected to any further torture and ill-treatment or a patently unfair trial."

The Foreign Office has defended the training offered to RAB as "fully in line with our laws and our values". A spokesman sought to suggest it was providing only "human rights training" for RAB, although RAB's head of training told the Guardian he was unaware of any human rights training since he was appointed last June.

Phil Shiner, of Public Interest Lawyers, which is bringing the legal challenge on behalf of Fayyaz Chowdury said: "The UK government owe the clearest of international obligations to my client, a British citizen, in circumstances where they are complicit in the torture of people like Mr Salauddin Chowdury. These obligations reflect international law principles that prohibit states from aiding and assisting other states in international crimes such as torture and extrajudicial executions. The UK government must use all means at their disposal to secure the immediate release of my client's father and to ensure that he cannot face a kangaroo court for war crimes that he did not commit."

MP tortured by security forces in Bangladesh

22 December 2010

Amnesty International is calling on the Bangladeshi government to immediately investigate allegations that a MP for the opposition Bangladesh Nationalist Party has been tortured while in police custody.

Bangladeshi security forces have tortured Salauddin Quader Chowdhury during interrogations, Amnesty International has learned. This has included applying electrodes to his genitals, beating him, slitting his stomach with razors and twisting his toenails and fingernails with pliers. There are fears that he may face further torture or other ill-treatment.

“The Bangladeshi government must ensure that Salauddin Quader Chowdhury is protected and treated properly and that these very serious allegations of torture are investigated,” said Abbas Faiz, Amnesty International’s Bangladesh researcher.

“In particular, the authorities must ensure that he has access to the necessary specialist medical attention, including by independent doctors.”

Chowdhury was arrested on 16 December in connection with a case in which a private car was set alight in Dhaka on 26 June, killing a passenger. On 19 December, the International Crimes Tribunal, a Bangladeshi court, issued an arrest warrant against him for alleged crimes against humanity during the 1971 Liberation War.

According to reports received by Amnesty International, a combined force of Rapid Action Battalion (RAB), Detective Branch (DB) police, and the Directorate-General Foreign Intelligence (DGFI) arrested Chowdhury in the early hours of 16 December at an apartment in the Banani neighbourhood in Dhaka.

Family members who were allowed to see him earlier today, told Amnesty International that Chowdhury reported that security forces came prepared with torture equipment as well as with a physician, and proceeded to torture him for several hours.

He told his family that he lost consciousness three times during the ordeal, and the doctor present revived him. However, when his condition deteriorated under interrogation, he was taken to the Bangabandhu Medical Hospital for treatment.

Video footage from the hospital grounds show Chowdhury weak, in pain, unable to walk on his own and with an apparent blood stain on his shirt.

After an hour in the hospital, Chowdhury was reportedly taken to headquarters of the Detective Branch of the Police (DBHQ), where he was subjected to further torture, including with electric shocks.

Family members who saw Chowdhury earlier today told Amnesty International that his genitals and nose were still bleeding, there were cut marks on his stomach and bruises all over his body. They said that he was very frightened for his life.

The police have said that he was taken to hospital to be treated for an asthma condition. The Inspector General of Police has denied that Salauddin Quader Chowdhury has been tortured.

Torture is widespread in Bangladesh, particularly during police interrogations.

“Given the detailed information provided by the family and the media, the possibility that Salauddin Quader Chowdhury was tortured must be taken seriously and the possibility that he may face further torture or other ill-treatment cannot be ruled out,” said Abbas Faiz.

Today the Court has ordered him to be placed in Dhaka Central Prison pending proceedings in his trial. According to Salauddin Quader Chowdhury’s family, he has not been allowed to meet his lawyers since his arrest, and was not present at the Court during today’s hearing. Instead, he was kept in the holding cell downstairs, where six members of his family were allowed to see him, under Court orders.

Chowdhury is 63 years old. He has suffered three heart attacks and has several cardiac stents.

“Amnesty International is deeply concerned about the allegations, and considers the reported torture of Salauddin Quader Chowdhury, as of any other human being, wholly unacceptable,” said Abbas Faiz.

“The government of Bangladesh is obligated under international human rights law, to protect all persons under its jurisdiction from torture and other ill-treatment at all times.”

'I was forced out'

haka, Nov 13 (bdnews24.com) — BNP chief Khaleda Zia broke down once again as she described how she had been, allegedly, dragged out of her cantonment house associated with most "intimate memories" of her life.

"They've uprooted me from my age-old memories," said Khaleda, referring to the eviction from her residence of 38 years from where she saw her husband, the military strongman Ziaur Rahman's rise and fall.

She claimed that the defence personnel had insulted her when she was being driven out of her house.

In a press conference at her political office on Saturday evening, the two-time prime minister claimed she was not given enough time to pack her bel;ongings.

BNP secretary general Khandaker Delwar Hossain, before her speech, had alleged that she was dragged out of the house, although the army said Khaleda Zia was leaving the house of her own volition.

"I have been living in that house for the last 40 years; a lot of memories of good and bad times are attached to that house."

"After president Zia gave his life for this country, the memories around that house became more vivid to me."

"Today, they have evicted me from that place full of nostalgia."

Terming the eviction as an atrocious act, the opposition leader said that she felt insulted and horrified by this "inhuman behaviour".

"They even did not hesitate to hit my family members."

If this is the way they treat the main opposition leader, you can well imagine what the situation of the common people is, she said.

The BNP chief claimed that law enforcers rammed the main entrance of her house.

"They have dragged me out after smashing my bedroom door."

Bursting into tears, Khaleda said law enforcers shoved her into the car.

"They [the government] are claiming that I left the house voluntary, which is nothing but a total lie."
