Witness in war crime tribunal is a convicted thief!

It comes as a surprise that the complaint of the high profile case against Jamaat-e-Islami leader Maulana Delwar Hossain Sayeedi before the war crime tribunal is a convicted thief. He was accused of and then sentenced to imprisonment in a robbery case for breaking into the house of a member of the Hindu community in his neighbourhood in the Najirpur upazila of Pirojpur district along with some others.
The man Mahbubul Alam Hawlader who filed the case in 2009 after 38 years of the liberation war on charge of crime against humanity is also now on bail in yet another case by his first wife on charges of violence against woman and demand for dowry.

An executive council member and three times elected MP from a Pirojpur constituency, Sayedee has been indicted on 20 counts of crimes against humanity at the International Crimes Tribunal set up to deal with such offences during Bangladesh’s Liberation War of 1971. His alleged crimes include murder, rape, loot and arson.
During the questioning by the defence lawyers in the tribunal, the complaint said he was a freedom fighter and had worked as the chief intelligence gathering agent for the freedom fighters in the district at that time. But the questioning revealed that he was only a 12 year minor at that time raising the question whether his claims were credible at all. How a minor boy could discharge such risky duty to cover military operations and gather secret information?
On further questioning Hawlader said he did not have the habit of reading newspapers at that time and but did not know the names of peace committee members of the district and the local upazilas. Neither could he recollect who were his immediate boss and other persons in the network. More interestingly, he has failed to name the place or the camp where he was trained as an intelligence gathering agent.
He told the court early last week that as a freedom fighter he is now living on state allowances. His second wife is also receiving state allowance to manage a square meal for the family members.
During the questioning on last Wednesday doubts further deepened on his claim as a freedom fighter. He told the court that he was not on the list of the freedom fighter until the last BNP government gave him the accreditation card. Further disclosures in the court showed when the present Awami League government came to power local party supporters submitted written objections to the incumbent MP Abdul Awal against Hawlader’s inclusion on the list of freedom fighters. The Lawmaker had then stopped his allowances which he was receiving as a freedom fighter on verbal instructions to the concerned authorities.
This prompted the defence lawyers to question whether under the circumstances he struck a deal with the administration by agreeing to file the case against Maulana Sayeedi as a war crime accused in return of his government allowances. Hawlader however turned down the suggestion as not true.
However, during the questioning it was revealed that complaint was a poor person living from hand to mouth. He managed to enlist his name as a freedom fighter during the last BNP government when Maulana Sayeedi was the local lawmaker.
Sayeedi had also twice recommended his petitions to the district deputy commissioner – once for financial assistance and subsequently to help him out to get some CI sheets to make roof of his house.
On questioning how he could turn against the man who has helped him so much, he said he did not personally approach him for those recommendations. Local Freedom Fighters Command secured the recommendations and Sayedi did his job as the local MP.
He had no credible answer on a question as to why he did not file the case against Sayeedi until last year.
The defence lawyers said after the liberation war when around 300 persons were sued for their involvement in war crimes, why he had not sued him at that time. He had no answer.
The defence lawyers said Sayeedi was the three times elected MP from the same Pirojpur constituency where he won the election every time with huge margin. Most freedom fighters had also worked for him in his electioneering process. Nobody had ever raised the question of his involvement in war crimes. He had even secured landslide margin in the village polling centre of the present Awami League MP as an honest credible person.
The defence lawyers are holding the cross examination of the complaint in the case with their arguments focused on proving that as a fraud and thief, the complaint has brought the case against Maulana Sayeedi on the prompting of the Awami League government.
He is a victim of conspiracy, they wanted to say. The cross examination may continue for some more days.
It is interesting to note that the prosecutions had opposed the disclosure of the contents of the petitions of Hawlader to district deputy commissioner in which he described himself as a poor man to justify his prayer for help. Earlier they had also raised objections on dealing with his personal profile.
The court however allowed the defence to continue these questioning despite objection from the prosecution however saying that any irrelevant sections will be expunged formal the records.

UN Human Rights High Commission about Nijami and others

The UN human rights high commission has wanted to know the origin of legal basis and ground of confinement of six apex war criminal e.g. Jaamat’s Amir Motiur Rahman Nizami and including Secretary General Ali Hasan Mohammad Muzahid. The commission has given a letter to Government and demand answer of 35 points specifically. The letter has been sent to the Ministry of Foreign Affairs through the chief of permanent mission of Bangladesh in Geneva on 12th September 2011. Although it was mentioned to reply the letter within 60 days but it did not become possible. It is informed to us that the Government has extended the time limit In the meantime.
The letter from the office of The UN human rights high commission captioned by “WORKING GROUP ON Arbitary DETENTION” The UN human rights high commission mentioned that jamaat leader Matiur Rahman Nijami, Ali Ahsan Mohammad Mujahid, Delawar Hossen Saidee, Kamaruzzaman, Abdul Kader Mollah, permanent committee member of BNP Salauddin Kader Chowdhury have been confined for trial and bring them to remand, identify condemned before trial, reject Bail petition and different issues have been indicted to them.
On the other hand the convener of International Crimes Tribunal Bangladesh Abdul Hannan Khan (PPM) ensures that they got the letter from The UN human rights high commission. He informed that they would not reply it yet. They are continuing communication with the Ministry of Foreign Affairs. Bangladesh Police is concerned about it and they will reply.
It is mentioned in the letter by the office of The UN human rights commission that Matiur Rahman Nijami, Ali Ahsan Mohammad Mujahid, Delawar Hossen Saidee, Kamaruzzaman, Abdul Kader Mollah, BNP leader Salauddin Kader Chowdhury is confined illegally which has been indicted in written form to them. Basis on that written complain a working group of The UN human rights commission is investigating on it. It is also mentioned in that indict that it is denominated freedom of that 6 BNP and Jamaat leaders.
It is also mentioned in that letter that they are deprived of justice and right of justice which is mentioned in the UN charter for human rights, the conditions have violated by confining them.
It is also mentioned in that letter that everybody has submitted petition for Bail again and again where they mentioned with submission that they will not go anywhere without permission of the proper authority. They will not interfere in trial. They will deposit cash in need their Bail. Above all, their Bail petition is rejected. Deputy Minister of the ministry of Law and Parliamentary Affairs Kamrul Islam said that, there is no chance of Bail of the war criminals. The complainant expressed anxiety to The UN human rights high commission and informed that Tribunal confined them without completing investigation. Even though, Tribunal do not serve any information to the accused petitioner.
The chief rapportier of ‘Working Group on Arbitrary Detention’ L. Hadji Malik Su demanded the answer from Abdul Hannan, the chief of permanent mission of Bangladesh in Geneva in the office of The UN human rights high commission against the complain submitted.
It is mentioned in the letter that, The UN human rights high commission deserve details by 60 days about the complain. Bangladesh Govt. can extend one month of the time limit if they would think necessary by informing the working group. If Bangladesh Govt. does not answer within this time limit the working group of The UN human rights high commission will express their opinion or speech based on the information they have.
It informed that, the Ministry of Home affairs sent the subject matter of 35 points to the convener of International Crimes Tribunal and the IGP of Bangladesh Police at 1stDecember 2011. The Bangladesh police Headquarter got the letter at 4thDecember.
A letter also sent to the Ministry of Home affairs by the Ministry of Foreign Affairs at 25thOctober which was received at 26th October by the Ministry of Home affairs.
It is mentioned in the letter that, Motiur Rahman Nizami was confined at 29th June 2010. The CMM court accepted remand for 16 days at 30th June on ground of the 5 suit filed against him in Palton Police Station. At 26th July it was granted 3 days remand on ground of suit filed against him in Kadomtoli Police Station. The relatives and the lawyers were not allowed to meet with him. During his confinement he was arrested as a suspected war criminal by the petition submitted by chief of International Crimes Tribunal at 22ndJuly. He was discharged from all suit filed in Palton Police Station, Kadomtoli Police Station at 29thand 30th November. The suit is pending which was filed in Motihar Police Station, Keranigonj Police Station, and Pallobi Police Station against Motiur Rahman Nizami. He can’t collect the certified copy of that suit being obstructed by International Crimes Tribunal. Abdul Kader Mollah, Assistant Secretary of Jamaat arrested at 13thJuly 2010. At 22nd July he has shown arrest by International Crimes Tribunal. Although he is discharged from all suit but he is confined for two ordinary suits filed in Keranigonj and Pallobi Police Station. The other Assistant Secretary of Jamaat, Mohammad Kamaruzzaman arrested 13thJuly 2010. Secretary General Ali Hasan Mohammad Muzahid and Naib-e –Amir Delawar Hossen Saidee has arrested at 29th Jun 2010. Permanent committee member of BNP Salauddin Kader Chowdhury has arrested 16th December 2010. Everybody has shown arrested during his confinement as suspected war criminal.

নিজামিদের অবস্থা জানতে চেয়ে সরকারকে জাতিসংঘ মানবাধিকার কমিশনের চিঠি

শাহজাহান আকন্দ শুভ, কবির আহমেদ খান: জামায়াতের আমির মতিউর রহমান নিজামী, সেক্রেটারি জেনারেল আলী আহসান মোহাম্মদ মুজাহিদসহ ৬ শীর্ষ যুদ্ধাপরাধীর আটকের কারণ, আইনের ভিত্তি জানতে চেয়েছে জাতিসংঘ মানবাধিকার হাইকমিশন। আটক এসব নেতাদের আইনজীবীদের আবেদনের পরিপ্রেক্ষিতে সুনির্দিষ্টভাবে ৩৫টি দফার সুস্পষ্ট জবাব চেয়ে সরকারের কাছে চিঠি দিয়েছে কমিশন। জেনেভায় বাংলাদেশের স্থায়ী মিশন প্রধানের মাধ্যমে পররাষ্ট্র মন্ত্রণালয়ের কাছে গত ১২ সেপ্টেম্বর এই চিঠি পাঠানো হয়। যুদ্ধাপরাধের তদন্ত সংস্থা আন্তর্জাতিক অপরাধ ট্রাইব্যুনাল ও পুলিশের মহাপরিদর্শকের কাছে এর জবাব তৈরি করে স্বরাষ্ট্র মন্ত্রণালয়ে প্রেরণের নির্দেশ দেওয়া হয়েছে।

জাতিসংঘ মানবাধিকার কমিশন ষাট দিনের মধ্যে ৩৫ দফা জবাব পাঠানোর কথা উল্লেখ করলেও তা সম্ভব হয়নি। ইতোমধ্যে সরকার এর সময়সীমা আরও এক মাস বাড়িয়ে নিয়েছে বলে জানা গেছে। জাতিসংঘের মানবাধিকার হাইকমিশনারের কার্যালয় থেকে ‘ওয়ার্কিং গ্র“প অন আরবিট্রেরি ডিটেনশন’ এর নামে প্রেরিত চিঠিতে উল্লেখ করা হয়েছে- জামায়াত নেতা মতিউর রহমান নিজামী, আলী আহসান মোহাম্মদ মুজাহিদ, দেলাওয়ার হোসাইন সাঈদী, কামারুজ্জামান, আব্দুল কাদের মোল্লা এবং বিএনপির স্থায়ী কমিটির সদস্য সালাহউদ্দিন কাদের চৌধুরীর আটকের বিষয়ে তাদের আইনজীবীরা আবেদন করেছেন। বিচারের নামে আটক রেখে রিমান্ডে নেওয়া, বিচারের আগেই দোষী হিসেবে চিহ্নিত করা, জামিন না দেওয়াসহ বিভিন্ন বিষয় উল্লেখ করা হয়েছে আবেদনে। এসব বিষয়ে হাইকমিশনের ‘ওয়ার্কিং গ্র“প অন আরবিট্রেরি ডিটেনশন’ বাংলাদেশের জবাব জানতে চেয়েছে। জাতিসংঘ মানবাধিকার সংক্রান্ত হাইকমিশন কার্যালয়ের চিঠি পাওয়ার কথা নিশ্চিত করেছেন তদন্ত সংস্থা ইন্টারন্যাশনাল অপরাধ ট্রাইব্যুনালের সমন্বয়ক মোহাম্মদ আব্দুল হাননান খান (পিপিএম)। তিনি আমাদের সময়কে বলেন, এ বিষয়ে তারা এখনও জবাব দেননি। পররাষ্ট্র মন্ত্রণালয়ের সঙ্গে এ ব্যাপারে যোগাযোগ রাখছেন। তিনি বলেন, ‘এ বিষয়ে পুলিশ কনসার্ন। তারা জবাব দিচ্ছে।’

জাতিসংঘের মানবাধিকার সংক্রান্ত হাইকমিশনারের অফিস থেকে বলা হয়েছে, মতিউর রহমান নিজামী, আলী আহসান মোহাম্মদ মুজাহিদ, দেলাওয়ার হোসাইন সাঈদী, কামারুজ্জামান, আব্দুল কাদের মোল্লা এবং বিএনপি নেতা সালাহউদ্দিন কাদের চৌধুরীকে অবৈধভাবে আটক রাখা হয়েছে বলে তাদের কাছে লিখিত অভিযোগ জমা হয়। ওই অভিযোগের পরিপ্রেক্ষিতে হাইকমিশনের একটি ওয়ার্কিং গ্র“প এ বিষয় তদন্ত করে দেখছে। অভিযোগে উল্লেখ করা হয়েছে, বাংলাদেশে ওই ৬ বিএনপি-জামায়াত নেতার স্বাধীনতা হরণ করা হয়েছে।

চিঠিতে আরও উল্লেখ করা হয়েছে, জাতিসংঘের মানবাধিকার সনদে যে ন্যায় বিচার এবং বিচার ব্যবস্থার অধিকার থাকার কথা উল্লেখ আছে, সেই সনদের শর্ত ভঙ্গ করা হয়েছে তাদের আটক রেখে। কী কারণে এবং কোন আইনের ওপর ভিত্তি করে তাদের আটক করা হয়েছে তার আইনি ব্যাখ্যা সম্পর্কেও জানতে চেয়েছে জাতিসংঘ মানবাধিকার সংক্রান্ত হাইকমিশনার।

চিঠিতে আরও উল্লেখ করা হয়েছে-যুদ্ধাপরাধের অভিযোগে আটক উল্লিখিত সবাই বার বার জামিনের জন্য আবেদন জানিয়েছেন। তাতে বলা হয়েছে-জামিন পেলে সংশ্লিষ্ট কর্তৃপক্ষের অনুমতি ছাড়া তারা কোথাও যাবেন না। বিচারে কোনও হস্তক্ষেপ করবেন না। জামিনের জন্য তারা অর্থ জামানত রাখার কথাও বলেছেন। এরপরও জামিন হয়নি। আইন প্রতিমন্ত্রী গণমাধ্যমে বলেছেন-যুদ্ধাপরাধীদের কোনও জামিনের সুযোগ নেই। এসব বিষয়ে মানবাধিকার কমিশনের কাছে উদ্বেগ প্রকাশ করে আবেদনকারী বলেছে-ট্রাইবুনাল তদন্ত সম্পূর্ণ না করেই তাদের আটক রাখছে। এমনকী তাদের আইনজীবীদের কোনও তথ্য দিচ্ছে না ট্রাইবুনাল।

জাতিসংঘের মানবাধিকার বিষয়ক হাইকমিশনার কার্যালয়ের ‘ওয়ার্কিং গ্র“প অন আরবিট্রেরি ডিটেনশন’ এর প্রধান রেপোরটিয়ার এল হাডযি মালিক সো জেনেভায় অবস্থিত বাংলাদেশের স্থায়ী মিশনের প্রতিনিধি মো. আব্দুল হান্নানের কাছে যুদ্ধাপরাধীদের বিচার নিয়ে করা অভিযোগের জবাব চেয়ে চিঠিটি দেন। ওই চিঠিতে উল্লেখ করা হয়েছেÑ সর্বোচ্চ ৬০ দিনের মধ্যে সংস্থাটি অভিযোগের বিষয়ে বাংলাদেশের কাছে বিস্তারিত তথ্য জানতে চায়। তবে বাংলাদেশ সরকার যদি প্রয়োজন মনে করে সেক্ষেত্রে ওয়ার্কিং গ্র“পকে জানিয়ে এক মাস সময় বাড়িয়ে নিতে পারে। এরপরও জবাব না দিলে মানবাধিকার কমিশনের ওয়ার্কিং গ্র“প তাদের কাছে থাকা তথ্যের ভিত্তিতে মতামত বা বক্তব্য জানিয়ে দেবে।

ইতোমধ্যে মানবাধিকার কমিশনের দেওয়া ৬০ দিন অনেক আগেই পেরিয়ে গেছে। তবে জবাব দিতে বাংলাদেশের পক্ষ থেকে সময় বাড়িয়ে নেওয়া হয়। জানা যায়, যুদ্ধাপরাধীদের বিচারের জন্য তদন্ত সংস্থা আন্তর্জাতিক অপরাধ ট্রাইবুনাল জবাব লিখছে।

জানা যায়, গত বছরের পহেলা ডিসেম্বর স্বরাষ্ট্র মন্ত্রণালয় থেকে উল্লিখিত ৩৫টি দফার বিষয়বস্তু তদন্ত সংস্থা ‘আন্তর্জাতিক অপরাধ ট্রাইবুনালে’র সমন্বয়ক ও পুলিশের মহাপরিদর্শকের কাছে দফাওয়ারী জবাব দেওয়ার জন্য প্রেরণ করা হয়। ৪ ডিসেম্বর পুলিশ সদর দফতর স্বরাষ্ট্র মন্ত্রণালয়ের চিঠি পেয়েছে বলে জানা যায়।

পররাষ্ট্র মন্ত্রণালয় থেকে গত ২৫ অক্টোবর স্বরাষ্ট্রমন্ত্রণালয়ে এ সংক্রান্ত চিঠি পাঠানো হয়। ২৬ অক্টোবর স্বরাষ্ট্রমন্ত্রণালয় তা গ্রহণ করে।

চিঠিতে উল্লেখ করা হয়েছে, মতিউর রহমান নিজামী ২০১০ সালের ২৯ জুন আটক হন। পল্টন থানার ৫টি মামলায় ৩০ জুন সিএমএম কোর্ট তাকে ১৬ দিনের রিমান্ড মঞ্জুর করে। ২৬ জুলাই কদমতলী থানার আরেক মামলায় তাকে ৩ দিনের রিমান্ডে নেওয়া হয়। এ সময় তার সঙ্গে আইনজীবী ও আত্মীয়-স্বজনের দেখা করতে দেওয়া হয়নি। আটক থাকা অবস্থায় আন্তর্জাতিক অপরাধ ট্রাইবুনালের প্রধানের আবেদনের পরিপ্রেক্ষিতে ২২ জুলাই তাকে সন্দেহভাজন যুদ্ধাপরাধী হিসেবে গ্রেপ্তার দেখানো হয়। ২৯ ও ৩০ নবেম্বর পল্টন, রমনা ও কদমতলী থানার সব কটি মামলা থেকে অব্যাহতি পান। মতিহার থানা, কেরানীগঞ্জ থানা ও পল্লবী থানার মামলাগুলো ঝুঁলে আছে। আন্তর্জাতিক অপরাধ ট্রাইবুনালের কারণে নিজামী ওই দুটি মামলার সার্টিফাইড কপি সংগ্রহ করতে পারছে না বলে অভিযোগ করা হয়েছে।

জামায়াতের সহকারী সেক্রেটারি জেনারেল আব্দুল কাদের মোল্লা ২০১০ সালের ১৩ জুলাই গ্রেপ্তার হন। ২২ জুলাই তাকে আন্তর্জাতিক অপরাধ ট্রাইবুনাল আটক দেখায়। সব মামলা থেকে কাদের মোল্লা মুক্তি পেলেও কেরানীগঞ্জ ও পল্লবী থানার দুটি সাধারণ মামলায় তাকে আটক রাখা হয়েছে। জামায়াতের আরেক সহকারী সেক্রেটারি জেনারেল মোহাম্মদ কামারুজ্জামান আটক হন ২০১০ সালের ১৩ জুলাই। জামায়াতে ইসলামীর সেক্রেটারি জেনারেল আলী আহসান মুহাম্মদ মুজাহিদ ও নায়েব-ই-আমির দেলাওয়ার হোসাইন সাঈদী গ্রেপ্তার হন ২০১০ সালের ২৯ জুন। বিএনপির স্থায়ী কমিটির সদস্য সালাহউদ্দিন কাদের চৌধুরী আটক হন ২০১০ সালের ১৬ ডিসেম্বর। আটক অবস্থায় পরবর্তী সময়ে উল্লিখিত সবাইকে আন্তর্জাতিক অপরাধ ট্রাইবুনাল সন্দেহভাজন যুদ্ধাপরাধী হিসেবে গ্রেপ্তার দেখায়।
